Allstate was supposed to compensate me for X amount of damage done to my car by the driver who had insurance upto 5 grand. Notice that I did not have insurance with AllState but that because the driver was at fault, and had coverage of upto $5000, AllState has agreed to pay me a portion of that 5 grand. However, the problem is the driver who was at fault is not agreeing to this and demands more in loss from AllState. Whereas, although, I myself deserve more in damage since the car was worth more than the amount I am being compenstated for, I have still decided to settle for less. Now because the driver is delaying the decision to accept the remaining amount out of 5 grand, this case/claim has not resolved SINCE 2010. They wouldn't send me check yet only because the driver needs to accept the offer also. My theory is that whether or not the driver finds the offer fair, is none of my problem. I shouldn't have to wait for 2 years only because the driver refuses their offer. I should get my share at least. Do I have a legal case against the company for taking too long in this regards ? What can I do to resolve this ?

Why did my lawyer tell the car insurance company to pay PIP directly to me when I asked to have my bill paid?

I spoke to my auto insurance company because my lawyer took two months to file my personal injury protection claim. Once, I took action into my own hands then I was assured that the woman handling my case from my car insurance company would see that my PIP paid for my medical expenses because I don't have health insurance. However, another month has passed and I have heard nothing from my lawyer about my case even though I call his office every week. So, today I received a letter in the mail from my lawyer office to my claim insurance person. It has her name on it but my address so I am not sure if it was intentionally sent that way or not. Yet, I read over it and it tells my insurance claim to pay the PIP directly to me and not to the medical company. What do I do about this? Has anyone gone through something similar and can you give me some helpful advice? I don't know if my lawyer is trying to add my PIP with the rest of the money that I will get so he can get a bigger chunk or if he is trying to get my PIP to me instead? Hi. I was involved in an at-fault car accident while driving a rental. Here is the rental situation: The rental car was not insured through the independent rental company. My insurance won't cover it either. I was never offered rental insurance and there was no contract signed regarding the car in question. The owner of the rental company has a rent-to-own business as well, and priced the car at $6,000, but is letting me pay just $4,550. According to Blue Book, the car is worth anywhere from $2,100 to $2,900. I'm willing to pay for the car. My question is, do I pay what he is asking or pay what the car is worth according to Kelly Blue Book? If I would have bought the car before the accident I would have never paid $6,000. It was only in fair condition when I got it. Thoughts? Thanks

OK, so just want an opinion. I just got a job to sell cars. Its slow right now, they said avg salesman sells about 8 cars a month. its a 1,000 draw,. $500 per month, and %25 to %30 commission. Long story short- we were in a car accident because this lady was trying to turn left over a double yellow line into the gas station and we hit her from behind. Back in October of 2010I was involved in a Hit and Run Accident. The Guy that hit us was found a few days later and we filed against his insurance. Me and my Fiance both went through Physical therapy for our backs. Medical bills totalled about 5K for me and about 8K for her. There were times when she was in tears because her back was hurting so bad. She Couldnt work some days either and she is self employed and works from home as a graphic Designer. State Farm Called and offered a settlement with me to pay the 5k to the Doctor and then a $1000 check to me for my pain and suffering. They called my Fiance to settle but she did not answer. My guess is they will probably offer her the same. Is Paid medical bills plus $1,000 fair? We missed work from it. Delt with stress and Physical therapy for about 3 months and not to mention all of the inconveniences associated with getting the car fixed and also dealing with insurance stuff. The guy that hit us was found a few days later but never offered a good excuse as to why he hit us and then ran. He originally filed a false claim with State Farm and said that he hit a tree and not another vehicle. It was all overturned against him once Geico called them and submitted the police report. My partner is having driving tests every week, and she is a more advanced driver. I just like to get advice on this matter, financial ? I do got a job, part time mainly. This student is a 20 unit UCLA Law major who needs money but can't even work a part-time job. Hey, three weeks ago, I got into a car accident and rear ended someone in the front with suv. I had a honda, and the insurance company declared it totaled and they are going to pay around 9k for the car. Since it was rear-end accident, insurance company held me for 100% at fault. The suv had broken/dented bumper and lower part of trunk lid dented (No broken lights or anything). I would say around few thousand dollars worth of damage. There were 3 people in the car and at the time they said they are all ok, and drove off. No police report was filed. When I called at night to get one of the guy's birthday, he said all three went to emergency, and had whiplash pain in neck area (which is understandable from rear-end accident). I had full coverage so I know my insurance comp. would pay their bills. The thing I am scared about is what if they sue me? My wife just got selected for a job in NC with our local paid EMS. They selected her but said there insurance company wouldn't cover her because of a PJC from 2003. I just had to bring my car to the shop for a repair. They ended up needing to keep it. Now a rental was covered under the warranty. So at least the rental was covered. But the guy had me signing off on insurance and what not. I guess the insurance on my car would cover the rental if I had an accident. But they would take from my cars deductible. So I basically signed off on a Collision Damage Waiver and also personal accident insurance. I did decline supplemental liability insurance though. Should the warranty be covering these fees or was this an extra that I got talked into? Because if the warranty covers the rental they aren't making anything. My understanding is it could be better because I am covered under their insurance if I have an accident and it wouldn't come off my own cars deductible? Kind of new to this and probably wouldn't have been worth trying to argue it after the fact that I signed off on stuff.So if I use this car for like 3 days I'm in it for like $60 in insurance. Hi, I am just curious because I know someone who does this but situation is a little different. His parents are split up so he has a car at his mother's house (where he would HAVE to be registered as primary driver) but he lives at his father's house so he only pays occasional driver's insurance even though the car is always with him. (both the father and mother have licenses however are not insured under the car in question) I am just asking if it were possible for me to do that with my grandmother for example. I recently was bumped into in my parking lot and am trying to settle with their insurance company for how much the repair fee would be. I took it to one place and it was around $2100 with damage to both the front and back door (they said the front door would need to be replaced). I spoke with their insurance company and they said I needed to take it to their place to have an estimate. I took it to their place, and the guy asks me if I was going to have it repaired their or somewhere else. I told him I would get it repaired somewhere else, which meant I would get a check he told me. He inspected it and told me that there was a 50-50 chance it would need to be replaced on the front door so his estimate was only for $1300. He said if I go get it fixed and they say it is more, that their insurance will pay the difference. This sounded to me like they are trying to say if you want the cash you only get $1300. What should I do? Should I try to negotiate with their insurance company for the difference or get more estimates that say I would need the new door? I would like the check, but I feel like I am getting ripped off since it would take more to actually fix it more than likely.

I need to renew my car insurance in the next few days but I am also moving to a new address in under 3 weeks time. This new address offers me much cheaper car insurance. I don't use my car much and can do without using it all for 3 weeks. If it is parked on the road and fully taxed is it a legal requirement to insure the vehicle even if it isn't used. I can live with it being stolen or damaged but I wouldn't want to be fined for being uninsured. The only problem with insuring the vehicle under my current postcode is that I'm at the whim of the insurance companies to what discount they offer me when I actually move. All the insurers I have phoned can't guarantee a fixed price for the new postcode if I register my the policy under my current postcode for the first 3 weeks. Hi guys. Well, to start out with I have my driver's license address set to my uncle's house in pembroke pines, FL, but I live here in Hialeah Gardens, FL. Im going to lay down what happened and I would appreciate your opinion. It started when my 2007 gs eclipse clutch gave out the dealership close to my house wasn't a very professional looking place when it came to their shop they mistreated the cars that where there and had old rusted cars parked in their lot. So, I did not want to get it repaired there, I made a big fuss with mitsubishi but after sitting the car in my lot for 2 months I lost my job and I had to get it fixed there anyway cause of warranty issues and I needed my car to look for another job i'm a truck driver that's why it took 2 months and my car had 7000 miles on it i hardly ever used it. I noticed that after I had it back the cruise control wasn't working I didn't take it back because of the fear of something worse happening to it. My mom suggested that I get repair by my cousins husband so my mom handed me her cell phone called him and told me to bring it in the morning because he worked all day til 7pm and if i couldn't get to him to leave the key under the plant in front of the garage door (that call was on 6-24-09). I tried to get there early enough (6-25-09) but i missed him and no one was home so I placed the key under the plant and left I told the police officer that I had made a call to him after dropping the key but the phone number to reach him was on my moms cell phone. I thought I did I couldn't remember because I came back a day later for the car. After I walked home I thought id leave it there a day so he could find the problem, since he gets home at 7pm. When I got there on 6-26-09 my car wasn't there and they said they never saw it there so i called the police to see if it was towed it wasn't and the key wasn't there either, police came over and took my statement but on the report he stated that the car was stolen on 6-26-09 and the phone number I used to call to tell them I was leaving the car there was written down wrong. The insurance company said that the inconsistencies where that I did not use my cell to make a phone call on the 6-24-09 or 6-25-09 I told them that i used my mothers cell phone in the oath recorded meeting they recorded my statement a week after i reported my car stolen and i failed to tell them i used my mothers cell phone but they didn't ask and I also told them I called when I placed the key under the plant but I was confused because I had called my cousin twice on 6-24-09. I never failed to make a payment on any of my bills and i have good credit score I'm in fact almost done with my car payment. They also brought to my attention that I tried to sell the car but i have proof that i've been trying to sell my car since 2008 and there was a buyer and i have his emails that offered to buy my car with a $1000.00 profit for me. please tell me what do think i should do about this situation?

Why should a patient pay for a money that is somehow added to your medical bills and medicine price because of pharmaceuticals research?. When it comes to college tuition and health care, everyone should put politics a side and draw a line between Capitalism and community assets. We elect our officials to provide us, secure us, and work for us, and when folks who only see making profit are more influential and more powerful than our elected officials than something must be done in here. I'm a 19 year college student. Currently I'm a closing manager at McDonald's and a certified Cisco Network Associate. I'm in the process of buying a vehicle and was optimistic about it until I started to look for insurance. The cheapest policy I've found is $338 a month. There isn't any way I can afford that and the car payment. It's not that I'm lazy and don't work, I work 40 hour weeks plus overtime from closing. I live in a rural area (North Georgia Mountains) so taking the bus isn't a option for a 20 mile commute. My closest neighbor is 7 miles away so car pooling isn't realistic. I feel somewhat hopeless. I would join my parent's policy or something similar but I live on my own and have little to no contact with them. I've been borrowing my Mother's car to get to work but she's given me 3 weeks to get a vehicle or walk. I have found it to be almost impossible to transition into the real world and become an adult and live on my own. What's a guy to do in my situation? I can't work without transportation, and without work I can't pay bills. That American Dream I grew up hearing about seems to only exist for people who have established wealth and good parents. What's left for the others? Are people in my situation just ******?

Last week, I had my husband's car parked up at work and I was notified that our car was broken into. The passenger side window was smashed and the thief took our GPS unit. The repair for the window cost 240 and the unit itself would be about 500. My husband call our insurance company and they said they wont cover it because we have a 500 dollar deductible for auto insurance and the GPS is considered home insurance which is 1,000. Is there anything that can be done to have insurance pay for this? I mean we want my company to be responsible for it but they are saying this isn't there issue. Any help would be great Thanks

Car Insurance not Paying (in Georgia)?

I was in an accident three weeks ago. It was the other car's fault. There were no injuries. We didn't call the police, but I got a written statement from the other driver admitting fault. I got her car and insurance information and filed a claim with her insurance. They sent an appraiser and I got an estimate for the damages. So all that is left now is for the insurance to approve the estimate and send me a check. I have called the insurance company almost everyday since I got the appraisal (about 2 weeks ago) and they are saying that they are waiting to get in touch with the policy holder; apparently they don't have her correct phone number. But they have the signed statement from her admitting fault. The agent in charge of my claim doesn't even pick up the phone or return my calls, I just talk to the operator who can't really give me any answers. I have the basic car insurance, I don't have collision coverage, so I haven't even called my own insurance. My car is operational but my rear susspension is gone, and the bent metal is hitting my tire; I really need my car rapaired asap. Should I call a lawyer even though there were no injuries? I should probably add that my car is not worth much, but I still need it fixed! and I can't afford (don't want either) to pay for repairs out of my pocket. What should I do? have a few issues I could really use some help with. The family car that I have been driving wasn't in my name but I was still covered on the insurance until one day I hit a mailbox with the passenger side mirror. The mailbox did not sustain any damage but the mirror somewhat did. I didn't call the police when it happened since the damage was extremely minimal. Anyways, then a couple weeks later a different family member (not the owner) had a little bit of a bigger accident when an animal suddenly appeared in front of the car forcing another accident. I have not had an accident in over 12 years but since I was mentioned after that second accident, I was also excluded from the insurance policy for that vehicle. The insurance cost is something like $158.00 per month but now they want the owner to add about $50 or $60 more per month EACH for the 2 people that were excluded because of the accidents.The car payment is about $415.00 per month and the insurance was $158.00 per month for just the owned which does not even drive the car at all but now they want an extra hundred per month for those 2 excluded drivers if they want to drive that car. Will this change if we switched insurance companies? And if I haven't had an accident in over 12 years, would it be possible to appeal that? Thanks in advance

I used to be amazed at the number of tickets other students used to get when I went to college. Temporary Insurance for 18 yr olds - How can I make this work?

I go to Uni and want to use my mothers car wen i'm back at home in the hols. Trouble is I'm only 18 and the car is a VR6 Highline, with UK group 16 insurance. It'll cost me about 2000 for a yearly permanent insurance policy, but id prefer just to go on my mothers policy temporary if itd b cheaper. For instance i could pay for her insurance on the car permanently for about 150 pound and maybe get on as a temp driver occasionally for probably a lot of money each time. Any ideas?

Moped insurance/ registration question in New Jersey?

okay, well i a tomos lx. and i am the first owner. And i called the dmv, and they told me that i need proof of insurance before i get it registered. heres my question. i am 15 and i would like to add the moped to my parents insurance policy. Can i go to the DMV with their insurance policy number and get it registered, go home, and then call the insurance company to put the moped on the policy? basically i show them my parents policy number. Will they accept it? Or do i need call the insurance company, add the insurance to my moped, and then go to the dmv?

Car accident person at fault has no insurance, what now?

had a car accident a week ago, minor injury to wrist havent gone to doctor, other persons fault, person B failed to yield while turning left and drove right in front of me. I have full coverage on my part, however fault being hers i made a claim to insurance she provided to police report. the thing is that the owner of vehicles insurance policy does not have person b listed on that policy but person b has same home address as policy holder so technically theyre insurance will not cover me. they have restricted non standard policy, and i do not have uninsured motorist coverage on my policy nor car rental coverage. their insurance is investigating this in he meanwhile so they say. i am not sure whether i should get my insurance to handle this, if i do i would have expect higher premium, pay deductible, rental car and medical fees out of pocket. I am wondering if i should have patience or start looking for a lawyer and forget my own insurance.

Why the health insurance are different than car insurance?

I mean insurance is protection and give you money when you got into situation that cause loss or expenses. But why car insurance are less picky and more willing to give money to pay out than health insurance? Why more rules and more restriction and more reject the coverage with health than car? I mean I understand insurance is business and for profit so they has to refuse the claims if loop hole. But it shouldn't be any different on health or car coverage.
